Jury finds Hebert defamed highway worker
A nearly 4-day trial and 6 hours of deliberation ended Saturday, Jan. 21 when a jury found 11-1 that former Barron County administrator Duane Hebert defamed former Highway Department patrol superintendent Gene Anderson.
The jury awarded Anderson a total $175,000 in compensatory damages. Payout of those damages is yet to be determined.
Post verdict motions, which will argue why the jury's total $175,000 award is or is not appropriate are due in 45 days after the verdict was issued. A date has not been set for that hearing.
There were three separate verdicts that the jury had to render. They involved statements made by Hebert dated Jan. 16, 2008 published by The Chronotype, The Chetek Alert and the Barron News-Shield.
The second verdict dealt with comments made by Hebert dated March 17, 2008 published in the Daily Reporter and the Leader- Telegram.
The third verdict focused on statements made by Hebert dated Jan. 21, 2008 published in the Daily Reporter and the Leader-Telegram.
In all three verdicts, the jury answered that the statements made by Hebert were not true or substantially true and that Hebert made . . .
